Ride supervision

Cancellation
. Rides go ahead only with a minimum of 5 participants.

When the right of withdrawal cannot be exercised in accordance with article L.221-28, the consumer must be informed that he/she does not benefit from this right or, as appropriate, be informed of the circumstances under which he/she loses his/her right of withdrawal: the right of withdrawal cannot be exercised for contracts covering: accommodation services, other than residential accommodation, goods carriage, car hire, catering or recreational activity services set to be supplied on a given date or over a given period.
. No rides started can be refunded.
. Rides start irrespective of weather conditions, except in case of an official French national meteorological service storm warning.

. You must be in good health and not have any good medical reason not to cycle.
Jurisdiction
- Any dispute relating to the interpretation of this contract or to the performance of these terms & conditions falls under the sole jurisdiction of (a) one of the courts with territorial jurisdiction by virtue of the French Code of Civil Procedure or (b) the court in the place in which the customer is staying at the time of entry into the contract or occurrence of the harmful event.
- French law alone is applicable.
General terms of sale – Holidays
1/ Sign-up:
Terms and conditions of sign-up:
These general terms of sale apply to bike holiday packages provided by Ardèche Vélo. The participant acknowledges that he/she has read and accepted them before confirming his/her booking. In case of group sign-up, the person who signs up in the name and on behalf of the different holiday participants acknowledges that he/she has read them and agrees to forward them to every traveller along with any information provided on the holiday.
Please note that holidays provided may require a certain level of physical fitness and technical aptitude (bike handling). Accordingly, we recommend that you carefully read the information on the physical fitness and technical aptitude required to undertake the planned holiday. It is incumbent upon every traveller to determine, based on the information provided, whether he/she possesses the necessary capabilities. If in doubt and before any sign-up, please contact Ardèche-Vélo plus any specialist (e.g.: general practitioner in case of medical history) to confirm your capability to undertake the planned route.
All sign-ups must be completed online on the website www.ardeche-velo.com. A booking form must be filled in by the participant when signing up. Receipt of an e-mail from Ardèche-Vélo confirms that the sign-up has been taken into account but does not confirm departure. The sign-up will be confirmed only after Ardèche Vélo sends a departure confirmation e-mail. The package will then be deemed definitively booked and confirmed. In accordance with art. L. 121-21-08 of the French Consumer Code, from confirmation of sign-up on the website, the participant can no longer benefit from a cooling-off period.
The participant must pay the full price of the holiday when he/she signs up on the website www.ardeche-velo.com.
Taking account of specific holiday characteristics, a minimum number of participants may be required. If this is the case, this number is stated in the holiday’s technical data sheet. The booking is confirmed only if the minimum number of participants is reached.
Physical fitness:
The participant must make sure that his/her physical condition is appropriate for the planned holiday. Ardèche Vélo cannot be held liable in case of lack of physical fitness, particularly demonstrated during the holiday. Ardèche Vélo reserves the right not to accept a participant who fails to meet the physical fitness and technical aptitude criteria stated for information purposes in the technical data sheet, and to refuse that the participant continue his/her holiday is this were to prove dangerous for either him-/herself or other members of the group, without the participant being able either to challenge the decision taken by Ardèche Vélo or to claim any damages or refund on this basis.
2/ Price and terms and conditions of payment:
Price of the holiday:
The services included in the price are stated in the holiday’s detailed programme. The total billed price may be different from the price stated in the catalogue or in the sign-up request, particularly taking account of additional services requested by the participant. The total price of the holiday, including any add-ons, is stated when paying on the website, then mentioned on the ticket.
3/ Cancellation insurance:
Ardèche Vélo provides each participant with the opportunity to take out cancellation insurance when signing up for the holiday. In case of cancellation by the customer up to 10 days before holiday departure, the operator refunds the full price of the holiday and any add-ons (excl. cancellation insurance costs). Less than 10 days before departure, the operator provides no refunds. This insurance takes effect from the moment it is taken out. From this date, the insurance premium is no longer refundable. The rate per person is all-inclusive.
If a participant uses his/her own policies, he/she must, on the first day at the latest, inform his/her guide of the name of the company, the policy number, and the telephone contact.
Changes during the holiday at the participant’s request:
Any changes to the programme at the participant’s request (extension, delayed return, changes to accommodation, etc.) can be made only with the guide’s consent and subject to both availability and payment of related costs by the participant.
Termination of the holiday:
If any holiday is terminated at the participant’s discretion (for health, physical fitness/technical aptitude, or other reasons), the participant is not entitled to any refund of unused services from Ardèche Vélo. Additional costs incurred as a result of this termination by the participant will not be refunded.
4/ Changes or cancellation by Ardèche Vélo:
Due to an insufficient number of participants:
When the minimum number of participants is not reached, the holiday can be cancelled no later than 7 days before the start of the holiday.
In this case, Ardèche Vélo is not required to pay any compensation or damages to the participant. The customer is informed by e-mail or telephone. The customer can then choose between a full refund of the sums paid or rescheduling up to the amounts paid. Any costs incurred by the participant remain payable by him/her (purchase of transport tickets, hotel, equipment required for the holiday, administrative costs).
Due to a force majeure event:
Force majeure events (unforeseeable and insurmountable incidents or events such as: political unrest, strikes, riots, weather conditions, natural disasters, etc.) can require a holiday to be cancelled. In this case, the customer is immediately informed by e-mail or telephone. The customer can then choose between a refund or rescheduling up to the amounts paid; he/she cannot claim any damages in this case.
Changes to the holiday:
Before departure, changes may be made to the programme (dates, times, itineraries, guides, accommodation, etc.) due to organisational or health issues. In this case, every participant is informed of this fact by Ardèche Vélo. If this change affects an essential component of the programme, the participant is entitled either to terminate the contract without claiming any damages, or to accept the change suggested by Ardèche Vélo. If the participant is present for departure, he/she is deemed to have accepted the changes.
During the holiday, changes may be made to the programme (dates, times, itineraries, guides, accommodation, etc.) due to organisational or safety issues. If Ardèche Vélo is in a position to do so, the participant is provided with replacement services. Otherwise, and except in case of a force majeure event, Ardèche Vélo will refund the price difference between planned and provided services.
Termination of the holiday:
Any holiday can also be terminated at the guide’s discretion for duly proven reasons. In this case, except if termination is due to a force majeure event, Ardèche Vélo refunds the price difference between planned and provided services.
5/ Liability:
Civil liability:
In accordance with the regulations applicable to our profession, Ardèche Vélo has taken out professional civil liability insurance.
However, Ardèche Vélo’s liability insurance does not replace the personal civil liability insurance that every participant is required to take out.
6/ Personal data:
Information collected on you is intended for Ardèche Vélo’s use and can be shared with any service provider to provide the service signed up for. In accordance with the French Data Protection Act (78-17 of 6 January 1978, amended in 2004), you are entitled to access, amend, correct, and delete any information on you by contacting: Ardèche Vélo. On legitimate grounds, you can also object to the processing of data on you.
7/ Disputes:
Traveller’s rights:
The combination of travel services provided to you is a package in accordance with directive (EU) 2015/2302 and article L. 211-2 II of the French Tourism Code.
You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed into the French Tourism Code. Ardèche Vélo will be fully liable for properly providing the full package.
Jurisdiction:
In case of any litigation relating to interpretation of this contract or performance of these General Terms of Sale – Holidays, the consumer can refer the matter to either one of the courts with local jurisdiction in accordance with the French Code of Civil Procedure, or the court in the place in which he/she was staying when either the contract was entered into or the proximate cause occurred.
Terms & conditions of hire
Equipment provided
- Tested, working bike (lights and bell provided).
- Helmet available on request.
- Basic breakdown equipment including puncture repair kit.
Booking
- 30% of the total cost must be paid at the time of booking.
- This sum can be paid remotely (card machine) or on site.
- No refunds in case of cancellation.
Hire rate
- Bikes are hired for the period and at the rate stated in the invoice.
- Supply and replacement of inner tubes are not included in the hire cost.
Payment and deposit
- Hire costs are payable in advance: any day or week of hire started cannot be refunded.
- A security deposit equivalent to the new value of the hired equipment must be paid (card machine).
- Deposits are refunded when equipment is returned, minus any damage or losses.
Minimum hire age
- Unaccompanied minors must provide written permission from their legal guardian.
Use
- The hirer certifies that he/she is capable of using the hired equipment.
- The hirer agrees to use the hired bike carefully, in accordance with the French Highway Code and without endangering third parties (articles 1383 and 1384 of the French Civil Code).
Return
- The hirer must return the bike in working order to the place from which it was hired.
- The hirer must report any damage during hire to the hire company.
- Any equipment lost or repairs required are billed at the applicable parts rates.
- The hire company withholds the deposit to cover the cost of any lost or damaged equipment.
Hirer’s liability
- The hirer is liable for the bike from the moment he/she takes possession of it until its return.
- The hirer is liable for any breaches of the French Highway Code.
- The hirer rides the bike on roads and paths at his/her own risk.
- The hirer is personally liable for bodily injuries and property damage he/she causes in the course of using the hired equipment in his/her care (articles 1383 and 1384 of the French Civil Code).
- In case of theft or accident, a report must be immediately filed with local / national police and the hire company must be informed without delay.
- In case of theft or if he/she is liable for an accident, the hirer or his/her insurer must pay compensation for the loss/damage sustained by the hire company (replacement value of the equipment plus loss of business); the hire company withholds the deposit to cover the cost of repairing any loss/damaged equipment.
Insurance
- The hire company’s insurance does not cover theft of equipment.
- The hire company disclaims all liability.
- The hire company is not liable for damage sustained or caused by the hirer in the course of use of the bike provided to him/her.
Right of withdrawal
When the right of withdrawal cannot be exercised in accordance with article L.221-28, the consumer must be informed that he/she does not benefit from this right or, as appropriate, be informed of the circumstances under which he/she loses his/her right of withdrawal: the right of withdrawal cannot be exercised for contracts covering: accommodation services, other than residential accommodation, goods carriage, car hire, catering or recreational activity services set to be supplied on a given date or over a given period.
